The Manitoba government introduced changes to planning and development legislation that are intended to improve the overall effectiveness of planning and development decision-making across Manitoba by establishing consistent approval timelines, a common appeal process through The Manitoba Municipal Board, and standardized ways of measuring application service standards.
Key areas that were changed or impacted by the legislation include:
New Service Standards (how long planning and development application reviews may take)
Zoning bylaws (the bylaws that affect zoning in Manitoba)
Conditional Uses for Large Livestock and Aggregate Operations
Reasons for Rejection (planning authorities must explain why an application is rejected)
Manitoba Municipal Board Appeal Processes and Time Limits (how The Manitoba Municipal Board operates with respect to planning matters)
Appeal Provisions (what application types may be appealed and how to appeal)
Planning Regions and the Capital Planning Region (Winnipeg and surrounding region)
Regional Plans and Adoption Process (regional planning requirements)
Changes made to planning and development legislation were introduced through three government Bills including:
Bill 37 – The Planning Amendment and City of Winnipeg Charter Amendment Act,
Bill 34 – The City of Winnipeg Charter Amendment and Planning Amendment Act, and
Bill 19 – The Planning Amendment Act (Improving Efficiency in Planning).
Most Bill 37 provisions came into force on October 29, 2021. Bill 34 provisions came into force in two parts on December 31, 2022 and September 1, 2023. Bill 19 provisions came into force in four parts on June 4, 2018, October 15, 2018, December 15, 2018, and November 1, 2019.
Purpose
The purpose of this survey is to collect feedback on whether the above legislation was successful in meeting its objectives and inform what government may do to improve planning and development.
